PUBLIC HEARING
FEBRUARY 13, 2006

The public hearing, authorized by the New Franklin Board of Aldermen, to consider the preliminary plat of Pecora Subdivision was opened by Mayor Jerry B Thornton Monday, February 13, 2006 at 6:30 pm at 132 East Broadway, New Franklin, Missouri. The attendance sign-in is attached to the Minutes of the Regular Board of Aldermen meeting. Members of the media and the public were given the opportunity to address the Board concerning the proposed subdivision. Mayor Thornton closed the public hearing at 7:00 pm.

The regular meeting of the New Franklin Board of Aldermen was called to order by Mayor Jerry B Thornton Monday, February 13, 2006 at 7:00 pm at 132 East Broadway, New Franklin, Missouri. Present were as follows:

1. Alderwoman Heilman moved to approve the Minutes of January 23, 2006. Alderman Nowlin seconded the motion. Five aye votes. No nay votes. Motion carried.

2. Alderman Nowlin moved to approve the Bills of February 13, 2006. Alderwoman Heilman seconded the motion. Five aye votes. No nay votes. Motion carried.

3. Alderwoman Heilman moved to have the first reading, by title only, of Bill No. 06-01, AN ORDINANCE TO AUTHORIZE THE MAYOR TO EXECUTE A CONTRACT BETWEEN THE CITY OF NEW FRANKLIN AND THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION PROVIDING FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF A SCHOOL CROSSING ON ROUTE 5 AT 500 FEET SOUTH OF BROADWAY STREET. Alderman Banks seconded the motion.

After the first reading, Alderman Banks moved to approve the first reading and have the second reading, by title only, of Bill No. 06-01. Alderwoman Heilman seconded the motion.

After the third reading, Alderman Banks moved to approve the third reading and pass Bill No. 06-01 in to Ordinance #700. Alderwoman Heilman seconded the motion.

4. After the third reading, Alderman Nowlin moved to approve the third reading and pass Bill No. 06-02 into Ordinance #701. Alderman Frevert seconded the motion.

5. Alderman Banks moved to have the first reading, by title only, of Bill No. 06-03 AN ORDINANCE DISALLOWING PARKING ON THE EAST SIDE OF CHANCELLOR STREET TEN FEET ON EITHER SIDE OF THE ENTRANCE TO THE ALLEY BETWEEN CHANCELLOR STREET AND NORTH UNION STREET. Alderman Frevert seconded the motion.

After the first reading, Alderman Nowlin moved to approve the first reading and have the second reading, by title only, of Bill No. 06-03. Alderman Banks seconded the motion.

After the second reading, Alderman Banks moved to approve the second reading and have the third reading, by title only, of Bill No. 06-03. Alderman Nowlin seconded the motion.

After the third reading, Alderman Banks moved to approve the third reading and pass Bill No. 06-03 into Ordinance #702. Alderman Nowlin seconded the motion.

6. Mayor Thornton opened the only sealed bid for the 1997 Ford Crown Victoria
Cliff McGee - Fifty one dollars ($51.00).

Alderwoman Heilman moved to reject the bid. Alderman Nowlin seconded the motion. Five aye votes. No nay votes. Motion carried.

7. Alderwoman Heilman moved to accept the preliminary plat of Pecora Subdivision. Alderman Frevert seconded the motion. Five aye votes. No nay votes. Motion carried.

8. City Administrator Cunningham advised the Board that she was withdrawing her request for a new photo copier; but would most likely recommended the purchase of a new copier within the next 2 years.

9. Alderwoman Heilman moved to approve the following transfers of funds from savings accounts to the general checking account:

Water Savings: $842.73 - chemical pump
$621.00 - chlorinator pump rebuild
$319.99 - oil pump replacement
$1783.72

From Sewer Savings: $467.00 - lift station pump repair

From Water/Sewer Bond Savings: $20078.28 - 2005 Bond
Payment
Alderman Frevert seconded the motion. Five aye votes. No nay votes. Motion carried.

10. Alderman Nowlin asked if there was a city ordinance disallowing the mini motorcycles on city streets. There was discussion but no action taken by the board.

11. The City Clerk read an e-mail from Ametra Franklin, from Franklin, LA giving an update of their situation after Hurricane Katrina and expressing again their thanks for the contribution from New Franklin, Franklin, and surrounding communities.

12. Alderman Frevert asked the Board to consider sponsoring a contest for the design of a city flag. The City Clerk agreed to contact the school art department; and to get cost estimates.

13. City Services Director Harvey had no report.

14. The board did not wish to consider the camera purchase without Chief Lusby present.

15. Alderman Banks moved to adjourn to closed session, pursuant to Chapter 621.021, (subsection 1, of the Revised Statutes of the State of Missouri). Alderman Nowlin seconded the motion.

16. Immediately following the closed session, Mayor Thornton reconvened an open meeting of the Board. Present were as follows:

Mayor Thornton, Alderwoman Heilman, Alderman Nowlin, Alderman Banks, Alderman James, Alderman Frevert, City Administrator/Clerk Cunningham, City Services Director Harvey, and City Attorney Robinson.

17. Alderwoman Heilman moved to authorize a pay raise to $12.00 per hour for employee Norman T Decker and further to authorize buying back 2 weeks of compensatory time from Mr. Decker. Alderman James seconded the motion. Five aye votes. No nay votes. Motion carried.

18. Alderman Banks moved to adjourn. Alderman James seconded the motion. Five aye votes. No nay votes. Meeting adjourned.
