BOARD OF ALDERMEN MEETING MINUTES
JULY 24, 2006


The regular meeting of the New Franklin Board of Aldermen was called to order by Mayor Jerry B Thornton Monday, July 24, 2006 at 7:00 PM at 132 East Broadway, New Franklin, Missouri. Present were as follows:

1. Public Participation - Travis Hundley, representing the informal committee of citizens wishing to revitalize the swimming pool, asked the city to consider acquiring and operating the pool as a public pool. The committee will meet again August 1 to elect new officers of the New Franklin Swim Club, Inc.; which is the first step of legal requirements to transfer ownership of the pool and its property to the City.

2. Roll call was taken by the City Clerk. All six members of the Board were present.

3. Alderman Nowlin moved to approve the Minutes of July 10, 2006. Alderwoman Heilman seconded the motion. Six aye votes. No nay votes. Motion carried.

4. Alderman Nowlin moved to approve the bills. Alderman McGee seconded the motion. Discussion: The City Clerk explained that the bills for work on the police department radios are reviewed with the Chief of Police and only those bills representing successful work completed by the vendor are paid. Alderman Nowlin called for the vote. Six aye votes. No nay votes. Motion carried.

5. Alderman Banks moved to have the first reading by title only of Bill #06-10, AN ORDINANCE PROVIDING "FAIR HOUSING" FOR THE CITY OF NEW FRANKLIN, MISSOURI. DEFINES DISCRIMINATORY HOUSING PRACTICES, AND CREATING A FAIR HOUSING COMMITTEE. Alderwoman Heilman seconded the motion.

After the first reading, Alderwoman Heilman moved to accept the first reading and have the second reading by title only of Bill #06 -10. Alderman Thompson seconded the motion.

After the second reading, Alderman Thompson moved to accept the second reading and have the third reading by title only of Bill #06 -10. Alderman Nowlin seconded the motion.

After the third reading, Alderwoman Heilman moved to accept the third reading and approve Bill #06 - 10 as Ordinance #709. Alderman Banks seconded the motion.

6. Alderwoman Heilman moved to have the reading by the Mayor of Resolution 07.24.06, A RESOLUTION OF THE CITY OF NEW FRANKLIN, MISSOURI, STATING INTENT TO SEEK FUNDING THROUGH THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND AUTHORIZING THE MAYOR TO PURSUE ACTIVITIES IN AN ATTEMPT TO SECURE FUNDING. Alderman Nowlin seconded the motion. Six aye votes. No nay votes. Motion carried.

7. After Mayor Thornton read Resolution 07.24.06, Alderman Banks moved to accept said resolution. Alderman Thompson seconded the motion. Six aye votes. No nay votes. Motion carried.

8. Alderwoman Heilman moved to have the reading by the Mayor of Resolution 07.2401.06, A RESOLUTION ESTABLISHING RULES AND REGULATIONS REGARDING THE USE OF EXCESSIVE FORCE DURING NON-VIOLENT CIVIL RIGHTS DEMONSTRATIONS, INCLUDING PHYSICALLY BARRING ACCESS TO A FACILITY OR LOCATION WHICH IS THE SUBJECT OF SUCH DEMONSTRATION, AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF. Alderman Thompson seconded the motion. Six aye votes. No nay votes. Motion carried.

9. After Mayor Thornton read Resolution 07.2401.06, Alderman Banks moved to accept said resolution. Alderman McGee seconded the motion. Six aye votes. No nay votes. Motion carried.

10. Alderwoman Heilman moved to accept the business license application by Oran Cates, Cates Construction. Alderman James seconded the motion. Six aye votes. No nay votes. Motion carried.

11. Alderman James opened discussion of drafting an ordinance that sets limits on the discharging on fireworks within the city limits. After the discussion, the city attorney agreed to draft an ordinance for the Board's review at the next regular meeting. Alderman Thompson suggested that the ordinance be read only once in its entirety at the next meeting, allowing time for public comment.

12. City Services Director - the 25 hp boat motor is not repairable. A new weed eater with attachments was purchased for $350.00 from Ron's Saw Service. Mr. Harvey is taking the test for certification to use restricted chemicals necessary for fogging for mosquitoes.

13. Police Department - radios are going back to Motorola for frequency resets. The radios operate without problems when in Columbia, but interference returns when operating in New Franklin.

14. Alderman Thompson moved to adjourn. Alderman McGee seconded the motion. Six aye votes. Meeting adjourned.
