BOARD OF ALDERMEN MEETING
AUGUST 9, 2010

The regular meeting of the New Franklin Board of Aldermen was called to order by Mayor C Frank Frevert Monday August 9, 2010 at 7:00 pm at 132 East Broadway, New Franklin, Missouri. Present were as follows:

1. Alderwoman Heilman moved to accept the agenda with no changes. Alderman McGee seconded the motion. Five voting aye. No nays. Motion carried.

2. Mrs. Maupin requested permission on behalf of the Santa Fe Trail Days Committee to apply for a liquor picnic license for Santa Fe Trail Days September 17 and 18, 2010. Alderman James so moved. Alderwoman Heilman seconded the motion. Five voting aye. No nays. Motion carried.

3. Alderman Banks moved to approve the Minutes of July 12, 2010. Alderman McGee seconded the motion. Four voting aye. Alderwoman Heilman - abstain - was not present at the July 12 meeting. No nays. Motion carried.

4. Alderman Thompson moved to approve the Minutes of July 26, 2010. Alderwoman Heilman seconded the motion. Five voting aye. No nays. Motion carried.

5. Alderman Banks moved to approve the bills for August 9, 2010. Alderman Thompson seconded the motion. Five voting aye. No nays. Motion carried.

6. Mr. Kevin Redden asked the Board to re-evaluate the invoice he received for 10 hours of backhoe provided by the city for laying the storm drain on S Union Street to take storm water off of Mrs. Helen Fisher's property. It was agreed the backhoe operator would be asked how many actual hours the backhoe was in use and the invoice would be discussed at the next regular meeting of the Board.

7. In the course of discussion concerning merchants' licenses, the Board reiterated that a professional tree trimmer, trimming or cutting trees for New Franklin residents can take limbs no larger than 3" in diameter to the city burn location on S Union Street.

8. Alderman Banks moved to have the first reading by title only of Bill No. 08.09.10.1, AN ORDINANCE AMENDING CHAPTER 675.440, SECTION D, CLASSIFICATION OF SEWERAGE SERVICE USERS BY THE CITY OF NEW FRANKLIN CHARGING A MINIMUM OF $8.50 AND A USER RATE FOR EACH 1000 GALLONS OF WATER USED OF $2.75. Alderman Thompson seconded the motion.

After the first reading of Bill NO 08.09.10.1 by title only, Alderwoman Heilman moved to accept the first reading and have the second reading by title only. Alderman McGee seconded the motion.

After the second reading of Bill NO 08.09.10.1 by title only, Alderman Banks moved to accept the second reading and adopt Bill No 08.09.10.1 as Ordinance #742. Alderman McGee seconded the motion.

9. Alderman Banks moved to have the first reading by title only of Bill NO 08.09.10.2 AN ORDINANCE CALLING A SPECIAL ELECTION ON A REVENUE BOND QUESTION IN THE CITY OF NEW FRANKLIN, MISSOURI. Alderman James seconded the motion.

After the first reading of Bill No 08.09.10.2 by title only, Alderman Banks moved to accept the first reading and have the second reading by title only of Bill NO 08.09.10.2. Alderman McGee seconded the motion.

10. Alderman Thompson moved to have the first reading by title only of Bill No. 08.09.10.3, AND ORDINANCE APPROVING A SETTLEMENT AGREEMENT WITH T-MOBILE AND ASSIGNING A PERCENTAGE OF THE SETTLEMENT PROCEEDS TO THE MISSOURI MUNICIPAL LEAGUE. Alderwoman Heilman seconded the motion.

After the first reading by title only of Bill NO 08.09.10.3, Alderman Banks moved to accept the first reading and have the second reading of Bill NO 08.09.10.3 by title only. Alderwoman Heilman seconded the motion.

After the second reading by title only of Bill NO 08.09.10.3, Alderman Thompson moved to accept the second reading and adopt Bill NO 08.09.10.3 as Ordinance #744. Alderwoman Heilman seconded the motion.

11. The Board considered reversing the 2008 decision of a voluntary tax rate reduction. The Mayor called for a motion but none was made.

12. Alderman Banks moved to have a public hearing August 18, 2010 at 6:45 pm to consider the tax rate with voluntary reduction, of $0.6048 per $100.00 valuation and further to have a special meeting of the Board to adopt the tax rate by ordinance August 18, 2010 immediately following a public hearing. Alderman McGee seconded the motion. Five voting aye. No nay votes. Motion carried.

13. Alderwoman Heilman moved to approve the transfer of funds for the 2005 Bond issue payment in the amount of $10,313.75. Alderman Banks seconded the motion. Five voting aye. No nays. Motion carried.

14. Alderman Banks moved to approve the transfer of funds for police equipment and uniforms in the amount of $4599.54. Alderwoman Heilman seconded the motion. Five voting aye. No nays. Motion carried.

15. Board members discussed merchants' licenses for local residents performing "handy-man" type jobs in the community. City Attorney Robinson suggested the Police Department use common sense; and further suggested that the final decision is an issue for the court. The Board also noted that the City Collector has the right to refer any merchant license applications to the Board of Aldermen.

16. Alderman McGee moved to authorize the Animal Control Officer to repair the animal shelter wood doorways and wood trim, possibly with sheets of tin, to comply with recommendations made by the State during a recent inspection. Alderman Thompson seconded the motion. Five voting aye. No nays. Motion carried.

17. Alderman McGee moved to adjourn to closed session pursuant to Chapter 610.021 (3) Personnel. Alderman Thompson seconded the motion.
