BOARD OF ALDERMEN MEETING MINUTES
OCTOBER 12, 2010

The regular meeting of the New Franklin Board of Aldermen was called to order October 12, 2010 by Mayor Pro-tem, Carolyn Heilman at 7:00 pm at 132 East Broadway, New Franklin, Missouri. Present were as follows:

1. Alderman Thompson moved to approve the agenda. Alderman Thornton seconded the motion. Six voting aye. No nay votes. Motion carried.
2. Alderman Thornton moved to approve the Minutes of September 13, 2010. Alderman Banks seconded the motion. Six voting aye. No nay votes. Motion carried.
3. Alderman Banks moved to approve the Bills for October 12, 2010. Alderman McGee seconded the motion. Six voting aye. No nay votes. Motion carried.
4. Alderman Thornton moved to have the first reading by title only of Bill No. 10.12.10.021 AN ORDINANCE IMPOSING ATTORNEY'S FEES ON COLLECTION OF ACCOUNTS RECEIVABLE. Alderman Banks seconded the motion.

Alderman Banks moved to accept the first reading and have the second reading by title only of Bill NO. 10.12.10.01. Alderman McGee seconded the motion.

Alderman Banks moved to accept the second reading and adopt Bill No. 10.12.10.02 as Ordinance 746. Alderman James seconded the motion.

5. Alderman Thornton moved to have the first reading by title only of Bill No. 10.12.10.02 AN ORDINANCE AUTHORIZING CIVIL ENFORCEMENT OF RECURRING ORDINANCE VIOLATIONS, AND REQUIRING THE DEFENDANT TO PAY ATTORNEY'S FEES OF THE CITY OF NEW FRANKLIN, MISSOURI IN ENFORCING THE SAME. Alderman McGee seconded the motion.

After the first reading, Alderman Banks moved to accept the first reading and have the second reading by title only of Bill No. 10.12.10.02. Alderman Thompson seconded the motion.

After the second reading, Alderman Thornton moved to accept the second reading and adopt Bill No. 10.12.10.02 into Ordinance 747. Alderman James seconded the motion.

6. Alderman Thomson moved to read Resolution 10.12.2010 to seek funding through Missouri Department of Transportation Enhancement Project. Alderman Thornton seconded the motion. Six voting aye. No nay votes. Motion carried.

7. Alderman Banks moved to adopt Resolution 10.12.2010. Alderman James seconded the motion. Six voting aye. No nay votes. Motion carried.

8. Alderman Thornton moved to authorize the City Collector to pursue 4 past due accounts through small claims court. Alderman Banks seconded the motion. Six voting `aye. No nay votes. Motion carried.

9. Alderman Thompson shared with the Board an article in MoDOT's publication "Connections" about the State Route 5 parkway.

10. Alderwoman Heilman asked the City Administrator to investigate the cost of putting electricity for lights in Shelter #2 at the City Park.

11. Alderman James moved to authorize the Police Department to donate 2 light bars and switches to Howard County Fire Department Station #2. Alderman Thornton seconded the motion. Six voting aye. No nays. Motion carried.

12. Chief Wells advised the Board the radar units have been installed and the new radios are in Columbia and will be programmed before delivery.

13. Halloween will be observed on its customary day of October 31st, Sunday.

14. Water Operator Koenig advised the board the chlorine gas regulator is in and installed.

15. Alderman Thompson moved to accept the bid from Lowe's for tin roofing materials, but only if the tin is within $200 of the bid for rolled roofing. Alderman McGee seconded the motion. Six voting aye. No nay votes. Motion carried.

16. Alderman Thornton moved to purchase Microsoft Office for the water plant computer and to purchase two licenses if the second license is less than the cost of a single license. Alderman Thompson seconded the motion. Six voting aye. No nay votes. Motion carried.

17. A meeting will be set to have the sewer project engineer meet with landowners of property near the city's lagoon to discuss land application process.

18. The Board approved the flyer to be mailed to citizens next week on the sewer bond issue. If citizens approach with questions, a public meeting could be held.

19. Alderman McGee moved to adjourn to an emergency closed session pursuant to Chapter 610.021 (3) Personnel. Alderman Thompson seconded the motion.
